SHC dismisses petition against PDA Constitution amendments and election results

Karachi-The Sindh High Court recently dismissed a petition against the new PDA Constitution and election results of PDA Karachi Branch.

Before the SHC, the petitioner challenged the amendments in the PDA Constitution deeming them illegal; they sought directions against the Central Council to nominate election commission; moreover, they appealed for the suspension of election results of PDA Karachi Branch.

A two-judge bench of the SHC headed by Justice Muhammad Ali Mazhar and Justice Agha Faisal pronounced the order dismissing the petition. After much argument and reasoning it was concluded that the petition was not maintainable against the PDA, which is a private association of medical practitioners and not amenable under writ jurisdiction; in this private association the government has no role to play nor this association is performing any functions in connection with the affairs Federation or Province.

The petition was, therefore, dismissed; however, the petitioners were given the right to file civil suit subject to all just exceptions.
